Will The Noose Tighten Human Rights?

A debate is going on for a long time in India with the pros and cons of capital punishment. So, the question is whether death sentence is a fair verdict? Is it violating human rights? The right of all living beings to exist is their birth-right. Death is inevitable, and irreversible. But, do we have the right to decide the death of a human? Compensation is another word complimentary to punishment. Only 58 nations (including India) are actively practicing capital punishment, whereas 95 countries have abolished the use of capital punishment. The Supreme Court ruled that death penalty should only be used in the ‘rarest of rare’ cases, but does not give a definition as to what ‘rarest of rare’ means. There can also be chances where an innocent can get framed and thus end up with a death sentence. Once a life is taken, it cannot be given back. But, our nation is privileged to have an appeal system and along with a mercy petition from the president which also helps in the reviewing of the case by the different judicial bodies and also by the first citizen of India himself. There’s been a big controversy around the world on the use of the death penalty; whether or not it should continue. Each single person has the right to live. Article 21 of the Indian Constitution provides ‘protection of life and personal freedom’ for its people – no person shall be deprived of his life or personal liberty except as provided for in the law. At times our laws and practices turn out to be a dilemma. Executing a convict may not bring back a person who is already dead, but executing the convict, future acts may be prevented. In order to ban death penalty in India, the public should be convinced that justice can be provided without executing. But, the public gets motivated to vote for death penalty as they are aware of the essence of corruption which is flowing through the law system. Abolishing the death penalty, however, can lead to higher crime rates, laws will be broken more frequently, and different kinds of illegally vigilant justice style may rise.
